Corteva - AFFF claims

Corteva Agriscience is a global agricultural and chemical company that formed as a result of mergers and spin-offs. In 1989, the Dow Chemical Company partnered with Eli Lilly to form DowElanco, which later became DowDuPont. In 2019, DowDuPont’s agricultural division launched as an independent company called Corteva Agriscience.

Despite the company’s split from DowDuPont, Corteva did not escape large lawsuits that were consolidated into multidistrict litigation in December 2018. The chemical company was named as one of the many defendants in Multidistrict Litigation No. 2873, also known as the Aqueous Film-Forming Foams Products Liability Litigation. This litigation covered lawsuits against AFFF manufacturers filed by state attorneys, public water utilities, military and civilian firefighters, and other individuals. In June 2023, Corteva was part of a settlement agreement with water districts, where Corteva would establish a $1.185 billion fund for PFAS-related water claims, along with Chemours and DuPont.

Corteva is a defendant in the AFFFF multidistrict litigation

There were 10,391 pending MDL dockets in the AFFF MDL by June 2025, and Corteva has been named as one of the defendants. In particular, Corteva has been associated with PFAS contamination of water systems through AFFF products. Corteva had been involved in the following settlements and lawsuits: 

  • May 2022: The Massachusetts Attorney General sued 13 manufacturers, including Corteva, for PFAS contamination of the state’s drinking water supply and damages to natural resources.
  • March 2022: North Carolina’s Cumberland County filed a lawsuit against Chemours, DuPont, and Corteva, alleging that the companies caused severe contamination of the county’s groundwater through PFAS in their products. In the same month, a federal court in New Jersey ruled against four companies, one of which was Corteva, and denied the defendants’ motion to dismiss a case related to PFAS contamination at New Jersey sites. In the same month, both DuPont and Corteva were facing lawsuits from Florida, Massachusetts, and South Dakota, alleging that DuPont spun off their chemicals business operations to escape PFAS contamination liability.
  • February 2022: The state of Colorado filed a lawsuit against Corteva and other AFFF manufacturers. The companies were accused of negligence, public nuisance, and unjust enrichment. The state was seeking financial compensation for remediation and continuous monitoring of PFAS-contaminated water systems.
  • November 2021: Corteva, along with other manufacturers like 3M and Chemours, was sued by California’s largest groundwater agency for selling industrial and consumer products that contained PFAS chemicals that polluted Los Angeles County’s drinking water.
  • July 2021: DuPont, Chemours, and Corteva agreed to a settlement with the state of Delaware for the environmental damage caused by PFAS chemicals through decades.
