MDL No. 3084 is a federal multidistrict litigation formally titled In re Uber Technologies, Inc., Passenger Sexual Assault Litigation, consolidating thousands of claims that Uber failed to protect passengers from sexual assault and driver misconduct. It was formed in October 2023 by the Judicial Panel on Multidistrict Litigation and is now pending before Judge Charles R. Breyer in the Northern District of California.
Unlike a class action, an MDL preserves the individual plaintiff’s lawsuit and damage claim. The cases are simply coordinated under one federal judge to streamline discovery and avoid inconsistent rulings. More than 3,000 plaintiffs have joined, making this one of the biggest sexual assault litigations currently active in the country.
Plaintiffs commonly allege that Uber:
Uber's internal safety data, driver complaint histories, background screening practices, and corporate knowledge of assault risks are all at the center of discovery. Early bellwether trials are ongoing and are expected to be a major factor in shaping future settlement talks and setting the value of pending cases.
Not every claim becomes automatically part of the MDL. Where the lawsuit is filed and the facts will determine whether it is brought into the proceeding or not.
